By accessing or using VAssumable, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Description of Service
VAssumable is an online marketplace that connects buyers and sellers of properties with VA assumable mortgages. We provide a platform for listing and discovering properties but do not directly participate in real estate transactions, provide legal advice, or offer lending services.
Third-Party (Partner) Listings
Some properties shown on VAssumable originate from other marketplaces. These are labeled "Partner listing" together with the name of the source site. For these entries we display a factual summary only, covering address, price, loan terms, and basic property attributes, alongside attribution and a link to the original page. We do not host the source site's photographs or listing descriptions, we do not verify the accuracy or availability of partner listings, and we are not a party to any transaction that begins on another site. Selecting a partner listing takes you to the source site, where that site's own terms and privacy policy apply. Partner listings are removed automatically once the source stops publishing them.
If you operate a source site and want your listings removed from VAssumable, email support@vassumable.com with the URLs. We will remove them and stop ingesting that source.
Important Disclaimer
VAssumable is a marketplace platform only. We are not a lender, mortgage broker, real estate agent, or legal advisor. All VA loan assumptions must be processed through the original lender and are subject to their approval and requirements. Users are strongly encouraged to consult with qualified professionals before proceeding with any real estate transaction.
User Accounts
To use certain features of our service, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
Listings and Content
When creating listings on VAssumable, you agree to:
- Provide accurate and truthful information about properties
- Only list properties you have legal authority to sell or represent
- Keep listing information current and update as needed
- Not post misleading, fraudulent, or deceptive content
- Comply with all applicable real estate laws and regulations
VA Loan Assumption Requirements
Users should be aware that VA loan assumptions involve specific requirements:
- The assuming buyer must qualify with the original lender
- Lender approval is required for all assumptions
- The original VA borrower's entitlement may remain tied to the loan unless released
- Fees and processing times vary by lender
- Not all VA loans may be assumable under all circumstances
User Conduct
You agree not to:
- Use the service for any illegal purpose
- Harass, abuse, or harm other users
- Post spam or unauthorized advertisements
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the service
- Scrape, crawl, or bulk-collect data from VAssumable without our written permission
Communication Monitoring
All in-platform messages, offers, and uploaded documents may be reviewed by VAssumable staff and automated systems for fraud prevention, safety, regulatory compliance, and quality assurance. By using the platform you consent to this monitoring. We do not sell message contents. Authorized staff include admins, moderators, and assigned transaction coordinators.
Limitation of Liability
VAssumable shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. We do not guarantee the accuracy of listings, including partner listings sourced from third-party sites, the completion of any transaction, or the conduct of other users. Our total liability shall not exceed the amount you paid for our services in the past 12 months.
Indemnification
You agree to indemnify and hold harmless VAssumable and its affiliates from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any rights of another party.
Termination
We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. Upon termination, your right to use the service will immediately cease.
Changes to Terms
We may modify these Terms of Service at any time. We will notify users of significant changes by posting a notice on our website. Continued use of the service after changes constitutes acceptance of the new terms.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
